Jay-Z‘s accuser can remain anonymous, a judge has ruled, while the rapperâs lawyer has been criticised for a ârelentless filing of combative motionsâ.
On December 8, it was reported that Jay-Z â real name Shawn Carter â was named in a lawsuit which alleged the rape of a 13-year-old girl in 2000 by the rapper and Diddy, real name Sean Combs.
In a statement issued via Roc Nation, Carter called the allegations âheinous in natureâ and dismissed them as a âblackmail attemptâ, and filed a court letter seeking the dismissal of the suit while maintaining his innocence. Combs also denies the accuser’s claims.
The letter also sought to reveal the identity of the accuser, but in a ruling on Thursday (December 26), Judge Analisa Torres declared that the woman can proceed anonymously in the case, as reported by Rolling Stone.
The judge pointed to the âweight of the factorsâ including the âhighly sensitive and extremely personalâ nature of the claim in making her decision, arguing it âtips the favour of allowing Plaintiff to remain anonymous, at least for this stage of the litigationâ.
Torres then added that the ârelentless filing of combative motions containing inflammatory language and ad hominem attacks is inappropriate, a waste of judicial resources, and a tactic unlikely to benefit his client. The Court will not fast-track the judicial process merely because counsel demands it.â
Carter and his representatives have not commented on the rulings.
Carterâs team had sued the accuserâs lawyer Tony Buzbee for extortion and defamation, claiming that his demand letter only gave a two-week window to commit to a âconfidential mediationâ regarding an alleged male and female victim. Both have claimed they were drugged and raped when they were minors.
Buzbee has called the claim âpatently frivolousâ and added that it âwill be dismissed,â per Rolling Stone. âIâve never said a word about him. This is just another attempt to bully and intimidate me. It just wonât work.â
It followed Buzbee filing a lawsuit against Roc Nation where he accused the company and its lawyers of using âshadowy operativesâ and promising to pay Buzbeeâs former clients to illegally entice them into filing âfrivolousâ claims against him.
Roc Nation has denied that accusation, saying the lawsuit is âbaloneyâ and a âpathetic attempt to distract and deflect attentionâ from the case. âMr. Carter is not someone who can be intimidated,â the rapperâs lawyers said, adding: âHe filed this lawsuit to pre-emptively call out Buzbee for the miscreant that he is.â
Earlier this month, the unnamed accuser, known in court documents as Jane Doe, admitted to making âsome mistakesâ in her recollection of that night.
In a video interview with NBC News, the woman, now 35, recalled the alleged events of the night from her memory as outlined in the lawsuit.
In a statement, Carter said the âincident didnât happenâ but Buzbee âfiled it in court and doubled down in the press.â
âTrue Justice is coming. We fight FROM victory, not FOR victory,â the rapper continued. âThis was over before it began. This 1-800 lawyer doesnât realize it yet, but, soon.â
The accuser is seeking unspecified damages, with the lawsuit filed under New Yorkâs Victims of Gender-Motivated Violence Protection Act.
Earlier this month, the NFL commented on the state of its relationship with Jay-Z and Roc Nation amid the allegations, stating that their ârelationshipâs not changingâ with Roc Nation.
