A decision on Everton’s appeal against a two-point penalty will be heard before the final day of the Premier League season. The Toffees have been deducted a total of eight points this campaign for breaches of the league's profit and sustainability regulations (PSR).
Everton were deducted 10 points earlier this season but had that total reduced to six upon appeal. A second charge then saw the club docked a further two points earlier in April.
An appeal against the second penalty was lodged by Everton last week. Now, the Premier League have confirmed that an outcome on the appeal will be made public prior to the final day of the Premier League season, which takes place on Sunday, May 19.
That will avoid clubs such as Everton and Nottingham Forest - who have also been sanctioned - not knowing where they stand even after concluding their respective campaigns. Everton and Forest, 16th and 17th respectively, are at risk of relegation heading into the final month of the campaign.
A Premier League statement read: “The independent Appeal Board has confirmed it intends to announce its decision regarding Everton Football Club before the last day of the current season.
“This follows Everton appealing the two-point deduction imposed by an independent Commission on the club following its admission of a breach of the Premier League’s Profitability and Sustainability Rules.
“The Appeal Board’s intention to make its decision public in advance of Sunday 19 May will provide certainty to all clubs and fans.
“If it is necessary, to achieve the intended timings the Appeal Board will publish its written reasons separately, by no later than 1 June 2024, in accordance with the Premier League’s Standard Directions.
“No further comment will be made in respect of the case until the Appeal Board’s decision is issued.”
PSR permits clubs to lose a maximum of £105million over a three-year period. An independent commission found Everton breached that by £16.6m for the three-year period to 2022-23. The earlier charge related to the three years up to 2021-22.
Everton occupy 16th place in the Premier League on 27 points, while Forest - who play the Toffees on Saturday - have 26 points. Luton, who occupy the final relegation spot ahead of Burnley and Sheffield United, are on 25 points.
Meanwhile, Everton owner Farhad Moshiri is attempting to give prospective buyers 777 Partners more time to complete their takeover of the club. The Premier League has given 777 a set of conditions to meet before they can complete their purchase.
